1. Acceptance of Terms
By accessing or using the AdelRIDE or AdelWINE website, mobile apps, booking widgets, driver portal or any related services (“Platform”), you (“User”) agree to be bound by these Terms of Service (“Terms”) and our [Privacy Policy]. If you do not accept these Terms, you must not use the Platform.
2. Definitions

ACL – the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Account – a registered customer or driver profile on the Platform.

Booking – a confirmed request for chauffeur transport or a Wine Tour made via the Platform.

Charges – amounts payable by a Customer for a Booking, including GST, tolls, parking, airport surcharges, wait-time fees, and any pre-disclosed third-party costs associated with a Wine Tour (e.g., tasting fees, lunch packages).

Customer – the person or entity that books a journey.

Driver – a chauffeur engaged by AdelRIDE holding all required accreditations.

Services – door-to-door passenger transport, hourly hire, event transfers, curated Wine Tours, and any ancillary services offered.

Tour Partner – a third-party entity, such as a winery, restaurant, or experience provider, engaged by AdelWINE to deliver part of a Wine Tour.

Wine Tour – a pre-booked, curated itinerary service offered by AdelWINE, which may include transport, winery visits, tastings, and meals.
3. Eligibility & Account Security
You must be at least 18 years old and legally capable of forming binding contracts. You warrant that all information supplied during registration and Booking is true, current and complete. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account.
4. Booking Process
4.1. Chauffeur Bookings: The Platform displays an estimate based on pickup/drop-off locations, selected service type, distance, surcharges and GST. A Booking is only confirmed once you receive an in-app or email confirmation and payment method is validated. 4.2. Wine Tour Bookings: Bookings for Wine Tours are typically customised and confirmed via direct correspondence or a dedicated booking form. The final price and itinerary will be outlined in a confirmation email. 4.3. Changes & Special Requests: For chauffeur services, contact our support line at least 2 hours before pickup for modifications. For Wine Tours, significant changes (e.g., to itinerary or guest numbers) require at least 72 hours' notice. All changes are subject to availability and may alter the Charges.
5. Services & Service Standards
5.1. AdelRIDE and AdelWINE provide chauffeured transport in licensed, roadworthy vehicles operated by accredited Drivers compliant with State/Territory passenger-transport legislation. 5.2. Vehicles are smoke-free, cleaned daily and insured at or above the statutory minimum. 5.3. Drivers will: * Arrive at or before the scheduled pickup time (subject to clause 11). * Assist with reasonable luggage handling. * Follow the most efficient or Customer-preferred route unless safety or road restrictions require otherwise. 5.4. For Wine Tours, AdelWinE will manage the itinerary, including bookings with Tour Partners, as outlined in the confirmed Booking.
6. Charges, GST & Payment
Variable Extras. Tolls, parking, waiting time beyond the included grace period (see clause 8) and any third-party fees are passed through at cost. Payment Methods. We accept major credit/debit cards, Apple Pay, Google Pay and other methods displayed at checkout. Charges are processed through Stripe Payments Australia Pty Ltd (ABN 44 160 180 343) and MYOB Pty Ltd (ABN 13 086 760 198) on behalf of AdelRIDE and AdelWINE. GST & Tax Invoices. All Charges are in Australian dollars and inclusive of GST unless stated. A tax invoice compliant with s 29-70 A New Tax System (GST) Act 1999 will be emailed upon successful payment.
7. Cancellations & Refunds
Our cancellation policy varies by Service. These rights operate in addition to any consumer guarantees under the ACL.
7.1. AdelRIDE Chauffeur Services:

More than 24 hours before pickup: No fee, full refund.

24 to 48 hours before pickup: 50% of the quoted fare will be charged.

Less than 24 hours before pickup or a no-show: 100% of the quoted fare will be charged.
7.2. AdelWINE Wine Tours:

Due to advance commitments and non-refundable booking policies of our Tour Partners, all cancellations or rescheduling requests for Wine Tours are generally non-refundable, regardless of the notice period.

Any potential refund is at the sole discretion of AdelWINE and is dependent on the terms of our Tour Partners.

We strongly advise all guests to take out comprehensive travel insurance to cover unforeseen circumstances that may lead to cancellation.
Refunds (if any) will be returned to the original payment method within 5-10 business days.
8. Waiting Time & Grace Period
8.1. Airport pickups: 30 minutes free from actual flight landing time. 8.2. All other pickups (non-tour): 15 minutes free. 8.3. After the grace period, wait-time is charged at AUD $1.50/min. 8.4. For Wine Tours, adherence to the agreed itinerary schedule is required. Significant delays caused by the Customer may result in forfeiture of a scheduled tasting or activity without refund.
9. User Conduct & Prohibited Uses
You must not:

Use the Platform for unlawful or misleading purposes.

Damage or soil the vehicle. Reasonable cleaning or repair costs may be charged.

Harass, abuse or endanger Drivers or other passengers.

Transport prohibited substances, weapons or live animals (except registered assistance animals).
10. Luggage & Passenger Limits
Standard sedans: max 4 passengers + 2 large suitcases. People-movers/SUVs: max 6 passengers + 5 large suitcases. Oversized items (skis, bikes, surfboards, etc.) must be declared at Booking. We may refuse carriage if space or safety rules are exceeded.
11. Delays, Force Majeure & Service Interruptions
We are not liable for delays caused by events beyond our reasonable control (severe weather, road closures, pandemics, vehicle breakdowns, or failure of a Tour Partner to provide a service for reasons beyond our control). If we must cancel a Booking due to such an event, you will receive a full refund of any pre-paid amount.
12. Australian Consumer Law – Guarantees & Liability
Nothing in these Terms excludes, restricts or modifies any rights you have under the ACL. To the extent permitted by law:

Our aggregate liability arising out of or in connection with the Services is limited to the amount you paid for the Booking giving rise to the claim.

We are not liable for indirect or consequential loss (loss of profits, business interruption, etc.).
13. Indemnity
You agree to indemnify and hold AdelRIDE, AdelWINE, their officers, employees, Drivers and Tour Partners harmless from any claim, loss or damage arising out of your breach of these Terms, misuse of the Platform or violation of applicable laws.
14. Intellectual Property
All content, trademarks and software on the Platform are owned by or licensed to AdelRIDE and AdelWINE. You may not copy, modify, or distribute it without our prior written consent.
15. Privacy & Data Handling
We collect and process personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. See our [Privacy Policy] for details. Location data is collected from your device and vehicles to facilitate the Services. By using the Platform you consent to this collection, use and disclosure.
16. Communications & Spam Act Compliance
You consent to receiving transactional emails, SMS or push notifications related to your Bookings. Marketing messages require your express opt-in and include a functional unsubscribe facility, as required by the Spam Act 2003 (Cth).
17. Third-Party Services & Links
17.1. The Platform may integrate with third-party services (Google Maps, Stripe, etc.). AdelRIDE is not responsible for the content or practices of these providers. 17.2. For Wine Tours, we engage with Tour Partners. While we select them with care, we are not responsible for the ultimate delivery of their services, though we will act as your liaison in case of any issues.
18. Suspension & Termination
We may suspend or terminate your Account immediately if you breach these Terms, abuse Drivers, engage in fraudulent activity or create a safety risk. Outstanding Charges remain payable.
19. Dispute Resolution
Internal Process. Email hello@adelridechauffeur.com.au within 14 days of the event. We will respond within 5 business days. Mediation. If not resolved, the parties agree to attempt mediation through the Resolution Institute before commencing court proceedings, except for urgent injunctive relief. Consumer Complaints. This clause does not restrict your right to raise a complaint with your State/Territory Fair Trading or Consumer Affairs agency.
20. Changes to Terms
We may amend these Terms by posting an updated version on the Platform. Continued use after the effective date constitutes acceptance of the new Terms. Material changes will be notified via email at least 7 days in advance where practicable.
21. Governing Law & Jurisdiction
These Terms are governed by the laws of South Australia and the Commonwealth of Australia. The courts of South Australia have non-exclusive jurisdiction.
